You will be captivated by the beauty, both inside and out when you visit this 4,000 sqft, 5-bedroom, 4-1/2 bath luxurious modern resort home. It's the only property situated on both the lakefront and golf course. The neighborhood is very quiet & friendly.

A. Some Key Rules & Policies Derived from the Rental Agreement:

USE RESTRICTIONS: This Rental Property is to be used by the renters for peaceful family gatherings ONLY. It is NOT to be used by the renters for parties/events, illegal activities, or loud activities inside and outside the house; No shouting, no loud noises in the front and back yard. Violation of this term will result in complete forfeit of the security deposit, in addition to any damages/losses caused by the renters and/or guests, and the renters may be asked to vacate this rental property and forfeit any rental payments.

BOOKING: The renter is required to book for all guests regardless of sleeping or just visiting at this property; no exceptions. This property is rented for use ONLY by the booked persons. Non-booked persons shall be charged $75 per person per night for the whole booking period (Term #5)

APPROVED GUESTLIST (Required by the HOA Security Office): At least ten (10) days before the arrival date, the renter(s) is required to provide
1) Her/his full name, age, phone number, and current legal address for verification, and
2) A list of all persons, with full names and ages (0 to 18+), who will be present at this property at any given time during the stay period of the primary renter, regardless of staying overnight or just visiting.
**If your booking date is less than ten (10) days before the arrival date, the above information must be provided within twenty-four (24) hours after booking.
NOTE: The total number of persons on the Approved Guestlist must match the number of guests booked/registered on the Airbnb record.
IMPORTANT: If the guest list is not provided by the due date, your reservation will be canceled; NO EXCEPTIONS.

OCCUPANCY: The renter agrees that any extra persons not on the Approved Guestlist shall be charged $75 per person per night for the whole stay period of the primary renter, regardless of staying overnight or just visiting. To avoid this costly and unnecessary charge, please book for all persons.

MAXIMUM OCCUPANCY: Ten (10) adults max, Four (4) children max, and Zero (0) infants.

RENTAL RATE: 93% of our renters have less than 10 persons (guests and visitors) in their groups. Therefore, our daily affordable and competitive base rate is set for up to 9 persons (ages 3 to 18+); Additional persons (from the 10th) will be charged a small fee of $29 per person per day for the whole stay period (not partial) of the primary renter. Please make sure to enter the correct number of persons, including visitors, during the booking. Airbnb webpage will do all the calculations automatically for you. ***Please note that there is no difference between staying and visiting persons at this property. Every person present at this property must be booked, registered, and paid. Otherwise, costly charges will apply.

Should you need to add more persons later, after booking, you can do so at least ten (10) days before your arrival date. The fee is $35 per person per day for the whole stay period of the primary renter.

PARKING: Five (5) vehicles maximum at this property - 3 on the driveway and 2 at the designated locations.

BOAT: One boat is allowed to park at the backyard dock. There are two waterfront marinas within 5 minutes from the house which rent boats, pontoons, jet skies, etc. You can also launch your own boat and park your trailer at those 2 marinas. Guests are not allowed to bring their boats/trailers into the April Sound subdivision.

COUNTRY CLUB: There is a four (4) minute walk to the April Sound Country Clubhouse. As our guests, you are allowed to fully access the country club's five (5) amenities with discount fees - $100 for 3-day access for a group of 2 adults and 3 children under 23 years old. Additional small fees are required for more guests and more access days. IMPORTANT NOTE: To help save the Clubhouse Access fees you should list on the "Form" ONLY the guests who need to use one of those 5 amenities. Please refer to the "Clubhouse Access Agreement" for details. Below are 5 available amenities:
a. Three swimming pools (1 for adults, 1 for young children, and 1 for toddlers)
b. Fitness center
c. Golf with extra fee (more details from the Clubhouse Access Agreement)
d. Tennis with extra fee (more details from the Clubhouse Access Agreement)
e. Club restaurant

***NOTE: The Clubhouse requires its own guestlist with Full Names and Birth Dates. It's different from the above list for the security office. You have to pay the access fee first, then We will help fill in and submit the form to them. You must provide this list and pay the access fee at least 7 days before your check-in date. Otherwise, there will be NO CLUBHOUSE ACCESS. As the owner(s) of the property, we have no control whatsoever over the clubhouse's services, fees, rules, and policies.

VACATION RENTAL AGREEMENT (attached below): The renter agrees to comply with all policies, terms, and rules of this agreement before booking.

PLEASE DO NOT BOOK IF YOU DISAGREE with the TERMS, CONDITIONS, and RULES SET FORTH in the RENTAL AGREEMENT, and the HOUSE's OVERVIEW. THANK YOU for YOUR UNDERSTANDING.

B. About The Property:

The house has very large and bright living, dining, and kitchen areas with beautiful custom ceiling treatments and trims. It has high ceilings throughout featuring a 21 ft. tall living room. All doors are 8 ft tall providing a more spacious facade. The house features two giant decks, an extra-large balcony and patio, boathouse, and cabana taking full advantage of the lake and golf course views that encompass the house!

The master suite is on the first floor with a sitting space overlooking the water through the bay of windows. It has a romantic view at night. It has a jet tub and a stand-up shower, one king bed, and a TV.

The second master suite is also on the first floor, overlooking the landscaped golf course, having its own large bathroom, and one queen bed.

The third and fourth bedrooms are on the second floor, having a Jack and Jill full bathroom, one queen bed for each room.

The fifth bedroom, also on the second floor, has its own full bathroom, 2 bunk beds for 4 persons (2 adults and 2 kids on upper level)

A huge game room and beautiful media room are on the second floor provided with a TV and a foosball table.

This Vacation Rental Agreement is for the rental property on

This agreement constitutes a contract between the “Renter(s)” and the “Property Owner”. Any money received by the Owner for occupancy of this Vacation Rental Property indicates the acceptance of the terms and conditions, rules of this agreement by the Renter.

Please read this agreement in its entirety before marking the “agree” checkbox on the VRBO reservation website.

ARE NOT ACCEPTABLE TO YOU

1. Check-In Time: after 3:00 P.M. Check-Out Time: before 10:00 A.M.

2. Use Restrictions: This Rental Property is to be used by the renters for peaceful family gatherings ONLY. It is NOT to be used by the renters for parties/events, illegal activities, or loud activities inside and outside the house; No shouting, no loud noises in the front and back yard. 4. Approved GuestList (Required by the HOA Security Office): At least ten (10) days before the arrival date, the renter(s) is required to provide
Her/his full name, age, phone number, and current legal address for verification, and
A list of all booked persons, with full names and ages (0 to 18+), who will be present at this property at any given time during the stay period of the primary renter, regardless of staying overnight or just visiting.
If your booking date is less than ten (10) days before the arrival date, the above information must be provided within twenty-four (24) hours after booking.
NOTE: The total number of persons (including infants) on your GuestList must NOT EXCEED the number of booked guests registered on the VRBO record. EXTRA GUESTS: When preparing the Guestlist, should you need to add more guests beyond your existing number of booked guests on the VRBO record, this is the only and last chance you can do so. The fee for adding extra persons is $35 per guest per night for the whole (NOT Partial) stay period of the contract.
5. Occupancy: The renter agrees that any persons (staying or just visiting) NOT on the Approved GuestList are NOT ALLOWED at this rental property at any given time during the stay period. Any extra persons not on the Approved GuestList shall be charged $75 per person per night for the whole stay period of the primary renter, regardless of staying overnight or just visiting. To avoid this costly and unnecessary charge, please book for all persons (it’s much cheaper.)

6. Arriving at the Security Guard (24/7) Shack: Tell the guards your NAME and the HOUSE’s ADDRESS. The guards will check the IDs every time you enter the gate. ONLY people on the "Approved GuestList" are allowed into the April Sound Country Club Community during your stay; no exceptions. Absolutely NO LAST MINUTE adding extra persons to the guest list.

7. Entering the Rental Property: The detailed CHECK-IN GUIDE will be sent to you three (3) days before your arrival date.

8. Parking: The maximum total number of vehicles parking at this property at any time during your stay is five (5) - three on the driveway and two (2) in the street. No parking in the garage.

9. Boat/Trailer: If you are traveling with a boat/trailer, you must launch your boat and park your trailer at any public/private ramp or marina of your choice. April Sound Security does NOT allow any guests to bring a boat/trailer into the April Sound subdivision. After launching, you can drive your boat to the house’s backyard dock. For your convenience, you may want to launch your boat, park your trailer, or rent a boat/pontoon at one of the following public marinas nearby (about 2 miles from the house) with reasonable fees. 1) April Plaza Marina at 17742 TX-105, Montgomery, TX 77356; phone # 936-588-11 four four; very good marina; launch and park trailer/truck $15 to $20 per day. 2) Lakeview Marina at 880 Beach Walk Blvd, Conroe, TX 77034; phone # 936-588-31 nine zero; above-average marina; launch and park trailer/truck $30 one-time charge for several days parking. Talk to Connie Henderson, manager, about this special discount fee for vacation rental guests. We have no business relationship with both of them.

10. Boat Slips: Please do not use the boat lift if you bring a boat with you; that lift is for private use only. You should dock and tie your boat to the boathouse or bulkhead.

11. Country Club’s Amenities: As our renters, the clubhouse allows you to access its five (5) amenities (golf, tennis, swimming pools, fitness center, and restaurant) with discount fees - $100 for 3-day access for a group of 2 adults and 3 children under 23 years old. Additional x fees are required for more guests and/or more access days. Please refer to the attached "Clubhouse Access Agreement Form" for details of fees, services, rules, etc. To access the clubhouse’s amenities, the renters are required to 1) provide a separate list of guests who need to use any of their amenities, 2) pay the total fee for those on the list via the Airbnb payment system, and 3) pick up the temporary access cards at the clubhouse’s front desk. To save your expense, please list only the guests who need to use the clubhouse's amenities. As the owners of the rental properties, we have no control over their operations, fees, services, rules, and policies. Please contact the Clubhouse directly at 936-588-11 zero one for any questions/concerns. An additional guest discount fee is required for playing golf and tennis. To play golf please contact the Pro Shop at 936-588-72 two zero.

At least 10 days before your arrival date, please send the “Clubhouse Access List” along with the above “HOA Approved Guestlist” to the owner (s) who then will fill in their required official forms, and submit them to the Security Office and the Country Club. See Appendix A below for instructions on what information the clubhouse needs from the renters; no list, no pay, no access.

*****Very Important Note: The temporary access cards can be picked up at the Club’s receptionist desk between 9 AM - 4 PM from Tuesday through Saturday; if you check in on Sunday or Monday, you can only pick up your temp cards on Tuesday.

THE RENTERS ARE FULLY RESPONSIBLE FOR ALL DAMAGES TO CLUB PROPERTY CAUSED BY ANY MEMBER OF THE RENTERS’ GROUP.

12. Smoking: Absolutely no smoking permitted in the house, on the decks, balconies, and the boathouse floor. Violation of this term will result in the complete forfeit of the security deposit.

13. Pets: Absolutely No pets are allowed at any given time during your stay. The Renter agrees to pay a fine of $1,000 per pet.

14. Balconies, Decks: Use the balconies and decks at your own risk. Children must always be supervised when using the decks and balconies.

15. Accessing the Water: Access the water from the bulkhead and decks at your own risk. Children must always be supervised when playing in these areas. The average water level is 5 feet deep.

16. Gas Grill: A gas grill is provided for your convenience. Renters are responsible for filling the propane tank if it is empty, and cleaning the gas grill after it is used. The grill should always be in the cabana area (behind the third car garage) and never be on the decks or patios.

17. Noise: The Rental Property is located in a quiet residential neighborhood with many retirees. Loud noise and music outside the house should be stopped by 10:00 PM out of respect for our neighbors. Please respect the neighbor to the right, they are elderly and permanent residents there. Bring all loud noise inside.

18. Locked Closets and Kitchen Cabinets: There are some locked closets/kitchen cabinets for the owner’s personal items. Please respect these areas as they are not intended for the renter’s use. The Master bedroom closet and pantry are locked.

19. Toilets: Please do not dispose of any tampers or sanitary napkins in the toilets; please throw in the trash cans. Please do not flush anything other than toilet paper. Failure to abide by this rule will result in the retention of your security deposit.

20. Trash: Trash pickup is Monday and Friday. Please bag all your trash and put it out for curbside pickup. Any excessive amount of trash left inside and/or outside of the house at the time of departure will affect the security deposit.

21. Renter’s Personal Items: Owner is not responsible or liable for personal items that are left behind, lost, or stolen. However, if Renter leaves an item behind after checking out and wishes to have it returned, Renter shall call Owner as soon as possible. If the item is found, Owner will arrange for shipment and will inform Renter of the shipping cost; upon Renter’s approval, Owner will deduct the shipping cost from the deposit.

22. Safety: Renter acknowledges and agrees that they are responsible for the safety of themselves, their guests, and their children with respect to the deck, boathouse, bulkhead, dock areas, and the premises. Renter acknowledges and agrees to hold harmless from any injuries to them or their guests.

23. Security/Damage Deposit: A security/damage deposit is required and must be paid in accordance with Payment Schedule. The deposit is refundable provided that all of the following provisions are met:

No violations of the maximum occupancy provision, ONLY registered guests/visitors are allowed at this property at any time during your stay;
No damage to the Premises, its contents, or its grounds;
No stains, scratches, hand prints on walls;
No stains on bath towels and any linens;
All debris, rubbish, and discards are bagged and placed in the large trash cans in the garage. Place these trash cans on the curbside for pickup (Monday and Friday ONLY);
All soiled dishes and kitchenware are washed and cleaned, and put them back where found;
All doors and windows are shut and locked upon check-out;
An extraordinary amount of cleaning is not required;
No violations of the no smoking and pet provision;
No citations of parking boat trailers on the driveway ($75 per day of violation);
There are no other costs incurred by Owner due to Renters’ and their Guests’ negligence; and;
No other provisions of this Rental Agreement are violated.

Violation(s) of any of the provisions of this Rental Agreement may result in partial or full forfeiture of the deposit.
The owner shall return the balance of the Deposit, less any charges, if any, to Primary Renter within fourteen (14) days after the termination of this Rental Agreement.

24. Hold Harmless and Indemnity: Owner(s) of this Rental Property shall not be liable for any damages and/or injury to Renters and their guests, or their personal property due to Renters’ acts, actions or neglect. Renters agree to hold Owner(s) harmless against any claim for damage and/or injury due to Renters’ act or neglect, or their guest's act or neglect.
Owner attempts to properly maintain the Vacation Rental Property. The Renter agrees to immediately notify the owner of any maintenance problem so that the situation can be remedied as soon as possible. The owner is not responsible for any inconveniences that may occur for which he has no control. This includes, but is not limited to power outages, adverse weather conditions, mandatory evacuation, construction, mechanical failures, pandemic. No refunds will be given for occurrences beyond the owner’s control.

25. Property Damages: The primary renter(s) is fully responsible for any damages and losses caused by any members of his/her group.

26. Renters Are Responsible for the Following Upon Check-Out:
NOTE: The cleaning team does not clean the areas outside the house, and the inside of the kitchen oven.
Make sure Patios, Balconies, Decks, Cabana, and Exterior Premises are clean of garbage, glass, etc.;
Put all outside furniture back where you found it and not strayed throughout the patio/yard;
Clean the outdoor gas grill, and the kitchen oven, if used;
Collect all your trash from every room, especially from the small trash cans. Bag all your trash and put it out for curbside pickup (Friday and Monday ONLY), or put it in the large trash can in the garage if your departure is on the other days;
Put all used bath towels in the provided baskets in bedrooms or bring to laundry room;
Wash and clean used dishes, cups, glasses, dinnerwares, kitchenware etc., and put them back where you found them;
Put all items back where they were found including all sofas and chairs (maids won’t put them back);
Empty and dispose of used foods and contents from the refrigerator; However, it’s OK if you wish to leave unused foods for the maids;
Close and lock all doors.

Appendix A
Clubhouse Access Required Information

No need to provide the info if no one wishes to use any of the clubhouse's amenities, otherwise below are what they need from the renters:

1. Access Period: From______ To______ (Note: more than 3 days, more fees)
2. Adult (above 22 yo) Names and Dates of Birth (Note: more than 2 adults, more fees, $50 each adult)
3. Children (below 23 yo) Names and Dates of Birth (Note: more than 3 children, more fees, $10 each child)

I will help fill in their entire Form, calculate and let you know the total fee. You will pay the total fee through VRBO before I submit the Form to them.
